TERMS OF SERVICE – iROCKET CAREERS

1. DEFINITIONS

1.1 “Service” – Refers to iRocket Careers’ recruitment services, platform, website, and related offerings.
1.2 “Client” – Any company or organization engaging iRocket Careers’ services.
1.3 “Candidate” – Any individual presented by iRocket Careers for consideration.
1.4 “Placement” – The successful hiring of a Candidate, defined as when the Candidate accepts a written offer and begins employment.
1.5 “Platform” – iRocket Careers’ website and related technology.

2. SERVICE DESCRIPTION

2.1 Core Service
iRocket Careers provides fixed-fee recruitment services for $3,000 per successful hire, which may include:

  • Candidate sourcing
  • Initial screening
  • Video interviews
  • Reference checks
  • Candidate presentations
  • Interview coordination
  • Offer support

2.2 Service Limitations
Certain restrictions may apply, including but not limited to:

  • Geographic limitations
  • Industry-specific restrictions
  • Position-level constraints
  • Custom pricing for specific roles

3. RECRUITMENT GUARANTEE

3.1 Guarantee Terms
iRocket Careers guarantees:

  • Delivery of 10 qualified candidates within 15 business days, provided that the Client promptly participates in the interview process and adheres to the agreed-upon timelines.
  • An additional 10 candidates within 5 business days upon request, provided that the Client completes interviews with the initial 10 candidates within 21 days. The Client must request additional candidates within 5 business days after this period. Failure to do so will void the refund guarantee. iRocket Careers will send an email reminder at the end of the 21-day period
  • 100% money-back guarantee if no hire is made from presented candidates, provided that the Client has adhered to all eligibility requirements, including timely interviews, feedback submission, and documentation compliance
  • Refund processing within 5 business days of a valid claim

3.2 Guarantee Eligibility Requirements
To qualify for the guarantee, Clients must:

  • Interview at least 10 candidates from the initial presentation unless a candidate declines the interview request, in which case the Client must provide proof of the candidate’s rejection
  • Provide feedback within one business week of the candidate’s presentation. Feedback must include one of the following: confirmation to proceed with an interview, a brief reason for rejection (e.g., not a skills match, cultural fit concern, salary expectations too high), notification that the candidate was unresponsive, or confirmation that an offer was extended and its outcome
  • Submit all required documentation within 10 business days of payment. Failure to provide the required documentation within this timeframe will result in forfeiture of the refund guarantee
  • Follow agreed-upon communication protocols, including responding to inquiries within a reasonable timeframe, providing timely updates on hiring decisions, and maintaining clear and professional correspondence with iRocket Careers
  • Maintain consistent hiring criteria throughout the recruitment process, ensuring that evaluation standards remain unchanged unless mutually agreed upon in writing

3.3 Required Documentation
Clients must provide:

a) Job Information:

  • Comprehensive job description
  • Role responsibilities
  • Required and preferred qualifications
  • Reporting structure
  • Team composition
  • Work location/remote policy
  • Compensation range and benefits

b) Hiring Process:

  • Decision-makers involved
  • Interview stages
  • Technical assessment requirements
  • Timeline expectations
  • Deal-breaker criteria

c) Company Information:

  • Current employee list and team structure
  • Growth plans relevant to the role
  • Company culture documentation
  • Onboarding timeline

3.4 Guarantee Exclusions
The guarantee becomes void if:

  • Job requirements significantly change during the search
  • Salary range increases or decreases by more than 10%
  • The position is canceled or frozen
  • An internal candidate is hired
  • Required documentation is incomplete or inaccurate
  • Feedback is delayed beyond one business week
  • The Client hires a presented Candidate within 6 months of service termination
  • The Client fails to interview a minimum of 10 candidates unless the Client can prove that no more than 10 candidates accepted the interview request
  • The Client violates any terms of service

3.5 Refund Process & Timeline

  • After the final Candidate is sent, the Client must complete all interviews within 21 days
  • The Client must notify iRocket Careers of any Candidates who rejected or ignored interview requests
  • Once the final Candidate has been interviewed, the Client has 10 business days to submit a refund request in writing
  • Alternatively, the Client may extend the contract and request additional Candidates instead of requesting a refund within the grace period if both parties agree. In such cases, the contract will begin a new cycle, and all terms of service will continue to apply

4. CLIENT OBLIGATIONS

4.1 General Responsibilities
Clients must:

  • Provide accurate and truthful information, ensuring that all job details, hiring requirements, and feedback are factually correct and up to date
  • Maintain professional communication by responding to inquiries in a timely manner and engaging in clear, respectful, and professional correspondence with iRocket Careers
  • Respect intellectual property rights, including proprietary recruitment methodologies, database information, and any confidential materials shared by iRocket Careers
  • Adhere to agreed-upon processes, ensuring that hiring decisions, feedback submissions, and documentation requirements are completed within the specified timeframes
  • Meet payment obligations as outlined in the agreement, including ensuring timely payment of invoices and any applicable fees
  • Protect Candidate confidentiality by safeguarding personal data, refraining from unauthorized sharing, and using candidate information solely for the purpose of evaluating potential employment opportunities

4.2 Communication Requirements
Clients must:

  • Respond to candidate presentations within one business week, ensuring timely decision-making and engagement in the hiring process
  • Provide specific feedback for rejected Candidates, including a brief reason for rejection to help refine future candidate selections
  • Notify iRocket Careers of any changes in hiring requirements as soon as possible to ensure the search remains aligned with the Client’s needs
  • Maintain regular communication during active searches, providing updates on hiring timelines and process developments
  • Inform iRocket Careers immediately of any hiring freezes, position cancellations, or significant changes in business conditions that affect recruitment efforts
  • Update iRocket Careers on Candidate progress through interview stages, including scheduling updates, interview outcomes, and hiring decisions

4.3 Platform Usage
Clients agree to:

  • Maintain account security
  • Keep login credentials confidential and do not share them with unauthorized individuals or third parties
  • Use the platform as intended and in compliance with all applicable terms, ensuring that usage aligns with the agreed-upon business purpose
  • Not attempt to circumvent security measures, access restricted areas, modify system configurations, or interfere with system integrity in any way
  • Report technical issues promptly, including any security breaches, unauthorized access, or system vulnerabilities that may compromise platform integrity
  • Not reverse-engineer, decompile, disassemble, or otherwise attempt to extract source code, algorithms, or underlying technology from the platform

8. PAYMENT TERMS

8.1 Fee Structure

  • $3,000 flat fee per successful hire, defined as when a Candidate accepts a written offer and begins employment. This fee is due 100% upfront unless otherwise agreed upon in writing or if a promotional offer is provided by iRocket Careers

  • Custom pricing for special roles (non-refundable unless otherwise agreed upon in writing). Special roles may include executive-level positions, highly specialized technical roles, confidential or stealth hiring, urgent hiring with expedited timelines, and roles requiring international recruitment or complex compliance processes. The fee for such roles will be negotiated and agreed upon by both parties. If an agreement cannot be reached, iRocket Careers reserves the right to either refund the fee or continue fulfilling the service under the base $3,000 fee structure.

8.2 Payment Conditions

  • Any remaining past-due balance is required to be paid within 10 business days of candidate acceptance unless otherwise agreed upon in writing or specified under a promotional offer by iRocket Careers
  • Multiple hire discounts are available, which may apply when a Client hires multiple candidates within a defined timeframe or engages in a long-term hiring agreement. Discounts will be determined based on factors such as volume, role complexity, and contract duration and will be agreed upon in writing before execution
  • Late payments incur a 0.5% fee per business day if not received within 10 business days of the due date
  • Refunds will be processed according to the guarantee terms, provided that all eligibility requirements have been met. Refund requests must be submitted in writing within 10 business days after the final candidate has been interviewed. Refunds will be issued via the original payment method unless otherwise agreed upon in writing

9. LIABILITY AND INDEMNIFICATION

9.1 Limitation of Liability
iRocket Careers is not liable for:

  • Indirect or consequential damages, including but not limited to business disruptions, operational delays, or reputational harm
  • Lost profits, revenue, or anticipated savings arising from the use of iRocket Careers’ services
  • Third-party claims, including disputes between the Client and any Candidate, regulatory compliance issues, or legal challenges related to employment decisions
  • Hiring decisions, Candidate performance, or retention outcomes, including any costs associated with Candidate turnover, underperformance, or failure to meet job expectations

9.2 Indemnification
Clients agree to indemnify iRocket Careers against:

  • False information provided, including but not limited to misrepresentation of job roles, candidate requirements, or hiring needs
  • Unauthorized platform use, such as sharing login credentials, accessing restricted areas, or attempting to manipulate recruitment data
  • Confidentiality breaches, including the unauthorized disclosure of candidate information, proprietary recruitment methodologies, or any sensitive data shared by iRocket Careers

10. DISPUTE RESOLUTION

10.1 Process

  1. Direct negotiation between the parties to seek a mutually agreeable resolution.
  2. If unresolved, legal proceedings may be initiated in a court of competent jurisdiction, with disputes governed by the applicable laws of San Diego County, California.

10.2 Governing Law

  • This Agreement shall be governed by and interpreted in accordance with the laws of San Diego County, California.

12. GENERAL PROVISIONS

12.1 Modifications
iRocket Careers reserves the right to update these Terms of Service as needed.

  • Clients will be notified of any changes via email or platform notification
  • Continued use of services after an update constitutes acceptance of the revised terms
  • Material changes that significantly impact service terms may require client consent before taking effect
  • If a client does not agree to the updated terms, they may choose to discontinue the service without penalty within 10 business days of receiving the notification
  • Any disputes arising from modifications will be handled in accordance with the governing law outlined in this agreement

12.2 Force Majeure
iRocket Careers shall not be held liable for delays or failure in performance due to causes beyond its reasonable control, including but not limited to natural disasters, labor strikes, cyberattacks, government actions, or pandemics.
